Terms of Service

These Terms of Service ("Terms") govern your access to and use of quickshotpaddles.com, QSConnect, and any related services (collectively, the "Services") provided by Quick Shot Paddles ("Quick Shot Paddles," "we," "us," or "our"). By using the Services, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, do not use the Services.

You must be at least 18 years old (or the age of majority in your jurisdiction) to create an account or make a purchase. You agree to:

• Provide accurate, current, and complete information.
• Keep your password confidential and secure.
• Be responsible for all activity under your account, and notify us immediately of any unauthorized use.

We may suspend or terminate accounts that violate these Terms, engage in fraud, or misuse the Services.

All orders are offers to purchase, subject to acceptance by Quick Shot Paddles. We may limit or refuse any order at our discretion — for example, if we suspect fraud, an item is mispriced, or stock is unavailable.

• Prices are listed in U.S. dollars and may change at any time before your order is accepted.
• Promotional codes (e.g., Hand_Built) may have restrictions — one use per customer, minimum order value, or category exclusions — as specified at issuance.
• We reserve the right to correct typographical errors, inaccuracies, or omissions and to cancel affected orders.

We accept major credit cards and other payment methods shown at checkout. Payments are processed by trusted third-party processors such as Shopify and Stripe. You represent that you are authorized to use the payment method you provide. Applicable taxes are added at checkout based on your ship-to address.

We ship from our Texas workshop using the carriers and timelines displayed at checkout. Title and risk of loss pass to you upon our delivery to the carrier.

Our Returns & Exchanges and Warranty policies are incorporated by reference into these Terms.

Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Services for personal, non-commercial purposes. All content, branding, designs, and software on the Services are owned by Quick Shot Paddles or its licensors and protected by intellectual-property laws. You may not copy, modify, distribute, sell, reverse-engineer, or create derivative works without our prior written permission.

If you submit content to the Services — reviews, photos, QSConnect posts, messages, or feedback ("User Content") — you represent that you own it or have all necessary rights, and you grant Quick Shot Paddles a worldwide, royalty-free, non-exclusive license to host, use, display, reproduce, and distribute it in connection with operating and promoting the Services.

You agree not to post User Content that:

• Is unlawful, defamatory, harassing, or infringes others' rights.
• Contains malware, spam, or unsolicited commercial messages.
• Impersonates any person or misrepresents your affiliation.
• Violates anyone's privacy or contains others' personal data.

We may remove any User Content and suspend or terminate accounts that violate these Terms, at our discretion and without notice.

You agree not to:

• Use the Services in violation of any law or these Terms.
• Interfere with or disrupt the Services, including probing, scanning, or bypassing security measures.
• Use bots, scrapers, or automated tools to access the Services without our written permission.
• Resell or exploit the Services for any commercial purpose without our authorization.
• Engage in fraud, chargeback abuse, or misuse of promotions and discount codes.

The Services and all products are provided "as is" and "as available" without warranties of any kind, either express or implied, including the implied warranties of merchantability, fitness for a particular purpose, and non-infringement, except as expressly stated in our written warranty. We do not warrant that the Services will be uninterrupted, secure, or error-free, or that defects will be corrected.

To the maximum extent permitted by law, Quick Shot Paddles and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, arising from your use of the Services. Our aggregate liability for any claim arising out of or relating to the Services or your purchases shall not exceed the greater of (a) the amount you paid Quick Shot Paddles in the twelve months preceding the claim, or (b) one hundred U.S. dollars ($100).

You agree to defend, indemnify, and hold harmless Quick Shot Paddles and its affiliates from and against any claims, damages, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to your use of the Services, your User Content, or your violation of these Terms or any law.

These Terms are governed by the laws of the State of Texas, without regard to its conflict-of-laws rules. Any dispute arising out of or relating to these Terms or the Services shall be resolved exclusively in the state or federal courts located in Texas, and you consent to personal jurisdiction and venue in those courts. Nothing in this section limits your rights under any mandatory consumer-protection laws that apply to you.

We may update these Terms at any time. Material changes will be communicated by posting the updated Terms with a new "Last Updated" date and, where appropriate, by additional notice. Your continued use of the Services after changes become effective constitutes your acceptance of the revised Terms. We may also modify, suspend, or discontinue any part of the Services at any time.

We may suspend or terminate your access to the Services at any time for any reason, including violation of these Terms. Upon termination, provisions that by their nature should survive (including Sections 6, 7, 9, 10, 11, and 12) will remain in effect.
